Law & Liberty: The 2nd Amendment
June 28, 2011

The ACLU of Idaho's Law & Liberty series starts with a bang. The 2nd Amendment, starting in the latter half of the 20th century, became an object of much debate and much of the debate has centered around the way the amendment is phrased. Is the amendment one that was created to ensure the continuation of state militias for defense or was it created to ensure an individual's right to own a firearm? Dr. David Adler, Director of the James A. Louise & McClure Center at the University of Idaho will discuss the historical context of the 2nd Amendment including Supreme Court decisions, and recent developments and debates around gun rights. Nullification was a hot topic last legislative session - so hot it prompted the introduction of three nullification bills. The Attorney General office issued an opinion that nullification was unconstitutional, which prompted the introduction of a bill establishing an Office of Legislative Counsel. Brian Kane, Assistant Chief Deputy Attorney General, explains the role of the Attorney General's office and the issue of nullification. (1 CLE credit pending)
