The ACLU of Idaho opposes HB 489, a bill that would create a new crime of wearing a mask while committing or attempting to commit a crime, and allowing optional sentencing enhancements.

We oppose HB 489 because of the risks it may pose to personal privacy, the health and safety of Idahoans and their families, and potential threats to protected speech and expression.

The bill would make wearing a mask, hood, “or other device that covers, hides, or conceals any portion of the individual’s face” while committing “or attempting to commit” a crime.
