The proposed bill amends Chapter 13, Title 39 of the Idaho Code by adding a new section, 39-1397, which establishes requirements for hospitals that accept Medicaid regarding the collection of patient immigration status data. Hospitals will be required to include a provision on their patient admission forms for individuals to indicate their immigration status, ensuring that responses will not affect patient care or be reported to immigration authorities. Additionally, hospitals must submit quarterly reports to the Idaho Department of Health and Welfare detailing the number of admissions and emergency visits categorized by immigration status.

Furthermore, the Department of Health and Welfare is tasked with compiling an annual report for state leadership that includes data on hospital admissions, emergency visits, and the costs associated with uncompensated care for undocumented individuals. The bill also defines "immigration status" and outlines the various categories of individuals it encompasses, including U.S. citizens, lawful permanent residents, nonimmigrants, refugees, and undocumented migrants. The bill is set to take effect on July 1, 2026, due to an emergency declaration.
