This bill replaced HB 693.

HB 764 would make it a crime for any organization, including churches, legal aid groups, and community organizations, to help undocumented immigrants. This also includes “promoting” services to undocumented folks.

Support could include:

  • Providing shelter
  • Providing financial support
  • Offering legal assistance
  • Providing transportation

Violating the law could result in misdemeanor charges for the person offering help. Helping five or more undocumented individuals could result in a felony charge.

Organizations could lose all business licenses and/or permits, and have to pay $3,000 for each undocumented person they helped.

How will HB 764 harm Idahoans?

This bill would foster a culture of fear and put critical services further away from vulnerable families. It could lead to racial profiling and discourage immigrant communities from engaging with law enforcement, reporting crimes, or seeking medical care.

Additionally, restricting immigrants’ ability to live and work in the state will harm local businesses, create labor shortages, and drive up costs.

Criminalizing empathy goes against Idahoans’ core values of compassion and care for our neighbors. This is not the Idaho way.
