SB 1322 amends Idaho voting laws around proving your identity with an affidavit. It requires you to provide either your date of birth, Idaho driver’s license, or state identification card number. The law also requires election judges to verify your information before issuing your voter ballot.
SB 1322 requires voters to provide additional personal information when completing an affidavit in lieu of a personal ID at the polls. After July 1, 2026, voters who request to verify their identity with an affidavit will be required to provide either their date of birth or their Idaho driver’s license or state ID.
Information you provide on your affidavit form will be verified by an election judge before you are issued a ballot.
The new law could have a range of impacts. If you face difficulty obtaining or submitting your ballot, please contact us. The law could cause longer wait times at the polls because it requires verification before issuing a ballot.
The verification process could also lead to voters being turned away at the polls. If the election judge tasked with verifying your affidavit is unable to do so, they may not issue you a ballot.
The law may create difficulties for specific communities at the polls. The requirement to verify affidavits prior to issuing your ballot raises concern that recent or partial name changes could result in being denied a ballot.
The new law could create longer wait times at the polls, whether you are submitting an affidavit in lieu of personal identification or not.
Many polling locations have minimal staff, and additional administrative burden (e.g., verification) could strain already scarce resources. Be prepared to wait: bring water, make a plan for childcare and other responsibilities, and budget extra time on election day.
You still have a right to submit an affidavit in lieu of personal identification on election day in Idaho. Because voter turnout increases during general elections, it is especially important to be prepared for longer wait times or administrative hiccups.
You can use your Idaho driver’s license or state ID card to prove your identity at the polls. Student ID cards are not valid identification for voting in Idaho.
You may also request an absentee ballot to vote in Idaho. You can request an absentee ballot online at VoteIdaho.gov. You’ll need to provide your driver’s license and the last four digits of your Social Security card.
